Sorry, Robert, but I feel the need to edit the title of this newsletter: ‘We have made it through the beginning of the worst.’

Hello Dear Robert Hubbell Readers! I just found a newsletter on Professor Heather Cox Richardson's newsletter reading list called "Imperfect Union." It is written by Lindsay Chervinsky. I just read one particular item from June 15 titled "Optimism When All Else Fails." (Sounds like something Robert would say.) It was inspiring to me. Since this has been a week that has left many of us exhausted, I thought this piece might also be uplifting to some of you. I hope so! Take care.

Robert, pace yourself. A friend of mine had fatigue and other bad effects for six months after experiencing break through.

This period of time when the SCROTUS is not in session would be a perfect time for Congress to expand the court, for Biden to put together his list of candidates, for confirmation hearings to take place and for the new justices to be sworn in. If those six reactionaries can so swiftly UNDO decades of democracy, surely the other two branches can be just as swift in putting the pieces back together again?

Happy to hear you are doing better. 48 hours of sleep is a great idea and would encourage you to continue that same routine for 2-3 weeks. Will be worth it!!

What an amazing summary of the rights we have lost. I have shared this with many, especially NC All On the Line where I am a member fighting gerrymandering in NC - we were thrilled when we won in the NC Supreme Court - but if the US Supreme Court takes up Moore v Harper, which is what we fought and won, NC fair elections will be in question. It has us all working hard to educate the population on what may occur and how we can fight it. Marc Elias and Eric Holder have come to NC to help us fight voter suppression and outright gerrymandering. NC is 1/3 Democrat, 1/3 Republican and 1/3 Independent yet with the gerrymandering case the Republican legislature tried to get 10 out of 14 Republican districts - their only apology was sorry we could not carve 11 out of 14! This went to the NC Supreme Court where it was declared gerrymandered and the maps were redrawn. Our only saving grace was the NC Supreme Court had a Dem majority!

Anyway - rest rest rest - Monday is another day to fight the good fight!

Sound quality is SO MUCH BETTER than on the Callin app! I prefer audio because of neurological issues that make reading difficult. It's been so frustrating to try to listen on Callin. The volume was all over the place and sound quality was poor. Thank you so much for trying another recording solution. It does seem like a good idea to get all current Senators on record. We're working our hearts out in NM-02 to flip this district and we fully expect to win. We're also developing programs to support down-ballot candidates. And most of our volunteers are donating, letter-writing, etc. for candidates in tough states and districts across the country. Imagine all this hard work pays off and we actually get a working majority in the Senate (52) and then when it comes time to act on the mandate they have been given, a couple more Senators peel off. I know it's borrowing trouble to worry about a negative outcome but I've been listening to young progressives who are giving their all to elect a real majority and I fear losing that bloc back to non voting if such a thing were to occur. I'm a bit jaded I guess, after seeing Manchinema gum up the works. Also, why is no one in the media asking Collins and Murkowski about a filibuster carve out for privacy rights? That just makes me see red! Thank you for being a light in the storm. I rely on your thoughtful analyses and measured optimism. PS: It's nearly impossible to know what your most beloved is/are thinking in real time. It is possible to know only what they may say or do - and misunderstandings need constant negotiation.

Any claim to know any Founder's intent - beyond what is in the written record - is just plain futzin' around. Attempts to impose such guesswork on these times should be a punishable crime. Sic Scampy Scalia! L&B&L

If the Constitution cannot respond to such differences as exist between these times, that result in large measure from the advent of electronics and AI, and the 18th century when it was written then it is a dead document and no longer useful.

In the Supreme Court the lack of rules to govern behavior and procedures makes fertile ground for questionable behavior. Secrecy/privacy have no place in government: the reason for any decision that affects so many lives needs to be clearly explained.

While there may be no such thing as a foolproof majority, there should be no situation in any branch of the US government in which a single vote/person can rule: Manchin, Mitchell. L&B&L

Thank you Robert. The quality of the sound of your article is excellent. Feel better soon. My wife and I, both fully boosted, contracted Covid. Took Paxlovid which worked wonders but had a recurrence within three days. All in all it took a month or so get well again. I’m fully recovered but my wife still has issues with taste and recurring dry mouth. Please rest. See you Monday.
