Dear Mr Fadem, many best wishes and congratulations on your Birthday. If my mother were alive she would be 97 tomorrow. I am delighted that you both share the same birthday and are of the greatest generation. Wishing you continued happiness & good health. Jan Russi Wotring

Hey, Robert. Sorry you couldn't spend more time basking in the glow that was Alaska! But your "back-in-the-saddle" newsletter ignites this reader to "soldier on."

Firstly, waiting patiently for the final results of the pending Pence & Perry "logjam."

Second, Happy 101, Lee Fadem! You're the bee's knees!

Third, I already have my list of voters to postcard to for Judge Protasiewicz. Hope to finish writing them in time to order some more. And of course will be donating to help her cause. Will check out Jessica's Extra! Extra! recommendations, too!

Happy Birthday, Lee Fadem! You are a national treasure!

As to Pence, while his momentary lapse of (poor) judgment on J6 may have been in service to the Constitution, his perversion of it to shield himself from either being held accountable for his possible complicity or to preserve his standing with his supporters does a tremendous disservice to the Constitution and our democracy. The Constitution is not an "invisibility cloak!"

Expand full comment

Quite right Bob. When it comes to protecting insurrectionists, the Constitution is meant to be like the emperor's new clothes.

PS for Mr. Fadem: I just read your contribution to the WWII Museum. My father was in the Army.. in the Pacific as well. Guam, Saipan, onto Ceylon. I do have a tape of him recounting some of his WWII experience. He didn’t talk about it a lot with us ...which I regret... but I think it was, as you say for you, an important and life-changing experience. Thank you again for your service and your generosity in sharing.

I just wrote to the WWII museum to let them know my nearly 99 year former Marine father would talk to them if they want.

Seriously Robert, you are getting angry emails from readers telling you how complicated these investigations are and that you need to be more patient?!!!! The fact that Trump and his coup plotting lackeys are today still walking around free is beyond me. That Merrick Garland is still Attorney General is beyond me. I've tried to tune out news on this case because I think it will end disappointingly.

I receive such emails every time I express my disappointment with Garland. They come mainly from DOJ alumni or lawyers in large firms who tell me how difficult it is to prepare a big case for trial. I know that. But this is important to the survival or the republic. "All deliberate speed" comes to mind.

Expand full comment

Right, the survival of the republic is at stake. This case should be Garland's highest priority.

Expand full comment

As they say, justice delayed is justice denied. Hopefully that won't be the case with Garland re: Trump.

And we still have creatures such as Marjorie Three-Names walking around inciting secession.

Nice defense of the grand jury forewoman. It is what she deserves.

As for the importance of not missing when shooting at the king, that is an aphorism that may or may not apply to Trump. It speaks to the danger that the powerful can take revenge. Whether it is Jack Smith or Fani Willis or some other prosecutor who achieves success against Donald Trump, we may not be too far away from a time when The Former Guy cannot take revenge against anyone.

Hi, Leonard. I agree with you that The aphorism applies to the political and career risks to the prosecutor if he or she brings a case but loses. That factor should be no part of the calculus on whether to charge Trump.

I'm hoping with everything I've got that you are correct in your assessment. This country deserves better than to have to wait two plus years for justice, however.

From Denialad: donbialostosky.substack.com

Too bad Mike Pence, beleaguered former Vice,

Did not have the good sense to seek advice—

Was he embarrassed to go to him twice?—

From J. Michael Luttig, whose clear, precise

Conservative legal opinions saved

Pence from carrying out Trump’s depraved

Demand to stop the vote count on the Sixth.

If Pence had asked this time, he would have nixed

Pence’s attempt to avoid testifying

By pretending it was disqualifying

To ask the Veep while he was presiding

Over the Congress while it was deciding,

Because the Constitution’s “speech and debate”

Clause protects members while they legislate.

If he’d asked Luttig this time, he’d have learned

This pretext would be quickly overturned

And his “Hail Mary” plea of last resort

Would not stand a chance in the Supreme Court.

Pence didn’t ask, and Luttig made his case

In a Times piece predicting Pence’s disgrace

In losing his appeals and ending with

His finally complying with Jack Smith.

Judge Luttig is acidly critical

Of Pence’s calling Smith political

And declares that it is otherwise:

“It’s Pence who’s chosen to politicize.”

He thinks before Pence brings his case to trial

His “lawyers need Smith’s number on speed dial”

To settle out of court and end his stand;

Luttig thinks Smith holds the winning hand.

I sometimes wonder if President Biden gave Garland the Attorney General job as a consolation prize for the fail at a spot on the Supreme Court. Garland appears to be better suited for the pace of the Supreme Court. It appears Garland has more than enough evidence to indict. What's the holdup?

Expand full comment

I think there are powerful people in the government that actually don't want him to be prosecuted.

Expand full comment

It may well be a consolation prize, one that turned into a booby prize for citizens of the United States. I cannot believe that I have found something to thank Moscow Mitch for accomplishing....keeping Garland off the SCOTUS. It is not a question of pace, it is a question of cowardice and competence.

Expand full comment

Actually I think he would have been good on the bench. He’s clearly a judge and not a prosecutor.

Happy 101, Lee! And thank you for your service. My late dad, Sidney Schuffler, was in the Navy during WWII stationed in Guam and the Phillipines. He wouldn’t talk about it and he’d never get near a boat again. My late two brothers-in-law, J.F. and Wood Reed saw battle in the Navy and Army, respectively. They both got shot up and never talked about it and both suffered from PTSD their whole lives.Thank you for sharing your story. I agree with Tom Brokaw’s assessment that you are part of “The Greatest Generation”. ❤️🙏
